1. Parties and capacity
These Terms are between the person or organisation making the submission (the “Contributor”) and Heritage International Institute (HII), Via Camilla 3, 00181 Rome, Italy, C.F. 96638600583. The Directorate General of Antiquities of Lebanon (DGA) is a project partner and beneficiary of the licence described below.
The Contributor confirms that they are at least 18 years old and have legal capacity to accept these Terms, or are acting with valid authority for the identified organisation or rights holder.
2. Ownership and no transfer
Submission does not transfer to DGA or HII any ownership or intellectual-property rights held by the Contributor or a third-party rights holder. The Contributor retains only those rights lawfully held in the submitted material.
3. Licence to DGA and HII
By submitting material, the Contributor grants DGA and HII a non-exclusive, royalty-free, worldwide licence to receive, store, preserve, digitise, catalogue, manage and reproduce the material as technically necessary for preservation and administration, and to use it only within the access level selected in the form. DGA and HII may use authorised infrastructure providers and project partners solely as needed to operate, preserve and safeguard the Archive.
The form offers two access levels: 1 — Public Access, which permits preservation and cataloguing as well as display on the Archive’s public digital platform and related online channels; or 2 — Preserve only, which permits preservation and cataloguing without public or research access. Submission does not itself guarantee publication, exhibition or acceptance into a final collection.
4. Contributor warranties, rights clearance and provenance
The Contributor represents and warrants that: (a) the material is lawfully in the Contributor's possession or control and has not been stolen, unlawfully removed, misappropriated, illicitly trafficked or otherwise unlawfully obtained; (b) the Contributor is the owner or rights holder, or has obtained all permissions and authorisations necessary to submit the material and grant the selected permissions; and (c) the submission and authorised uses do not infringe copyright or related rights, privacy, image rights, confidentiality, cultural-property rights, contractual restrictions or other rights.
Where the Contributor is not the owner or sole rights holder, the Contributor must disclose that circumstance and provide reasonable evidence of authority upon request.
5. Sensitive material and people under 18
The public form must not be used to submit passwords, financial information, medical records, criminal-offence data, highly confidential correspondence or material whose lawful submission has not been established. Material involving minors, highly sensitive personal data, sacred or restricted community knowledge, security-sensitive locations or serious safety risks must be discussed with HII before submission through info@lebanonarchive.org.
HII may restrict, redact, quarantine, reject or remove material where additional protection or legal review is required.
6. Contributor responsibility, cooperation and indemnity
The Contributor is responsible for the accuracy, completeness and legality of the declarations made and for obtaining all necessary rights and permissions. The Contributor must promptly notify HII if any declaration becomes inaccurate or a dispute or rights issue arises, and must reasonably cooperate in resolving it.
To the fullest extent permitted by applicable law, the Contributor shall indemnify and hold harmless DGA and HII, their officers, employees and authorised project partners from third-party claims, losses, liabilities, damages, settlements, penalties and reasonable legal or administrative costs arising from the Contributor's breach of these Terms, lack of authority, false or misleading declaration, unlawful provenance or infringement of third-party rights. Nothing excludes liability that cannot lawfully be excluded.
7. No verification, certification or duty to investigate
Receipt or acceptance of material does not constitute verification, authentication or certification by DGA or HII of ownership, authorship, authenticity, provenance, legal title or rights clearance. DGA and HII may rely on the Contributor's declarations and supporting documents and may request additional evidence before making material accessible.
8. Rights claims, restriction and takedown
DGA and HII may immediately suspend public access to, restrict, quarantine or remove material upon a credible ownership, provenance, copyright, privacy, confidentiality, cultural-property or other legal concern. Where lawful and appropriate, a restricted preservation copy may be retained while the matter is assessed. Relevant information may be provided to competent authorities where appropriate or legally required.
9. Attribution
DGA and HII will make reasonable efforts to respect the attribution preference selected by the Contributor. Attribution is not certification that the Contributor is the author, owner or rights holder. Credits and rights information may be corrected where better evidence becomes available.
10. Preservation, access changes and prior uses
The Contributor may request a future change to the access level or removal of public access. DGA and HII may retain restricted archival copies where lawful and reasonably necessary for preservation, archive integrity, legal compliance, audit, evidence of submission history or the historical record. Uses already lawfully completed in publications, exhibitions, research or educational outputs need not be withdrawn where withdrawal is impracticable, but no new use will exceed the permissions then applicable.
11. No financial compensation
Contribution is voluntary. No royalty, fee or other remuneration is due for uses authorised under these Terms unless DGA and HII expressly agree otherwise in writing.
12. Privacy and service providers
Personal data is processed by HII in accordance with the Archive Privacy Notice. Material is transferred through HII's hosting provider to the CNR/DARIAH archive infrastructure. CNR controls its internal security screening and workflow after receipt; the public website does not move submissions between CNR review stages.
13. Availability and submission limits
HII may suspend the form for maintenance, security, capacity or legal reasons and may reject incomplete, unsafe, unlawful, duplicate or technically unsupported submissions. The online gateway accepts up to ten files. Ordinary files may be up to 100 MB each, one designated special file may be up to 500 MB, and the total submission may be up to 750 MB.
14. Governing law and jurisdiction
These Terms and non-contractual obligations arising from them are governed by Italian law. Any dispute shall be subject to the courts of Rome, Italy, without prejudice to mandatory rights or jurisdiction granted to the Contributor under applicable law.
15. Changes, severability and contact
If a provision is invalid or unenforceable, the remaining provisions continue to apply. Material changes will be published as a new version; the version accepted with each submission is recorded in its archive package.
Questions, rights claims and takedown requests: info@lebanonarchive.org.
